Acceptance

By accessing or using the Recall Nexus - Health Recall Intelligence Platform (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

Pre-alpha status

The Service is currently in a pre-alpha stage of development. Features, data, functionality, and availability may change without notice. The Service may experience outages, bugs, inaccuracies, or incomplete functionality.

Informational purpose

The Service is intended to provide informational access to publicly available recall information. Official government sources remain the authoritative source for recall information. Users are responsible for independently verifying information before relying upon it.

No warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Completeness
  • Reliability
  • Availability

We do not guarantee that:

  • Information is accurate
  • Information is current
  • Alerts will be delivered
  • Searches will return complete results
  • The Service will be uninterrupted

Limitation of liability

To the fullest extent permitted by law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or reliance on information provided through the Service.

This includes, without limitation, damages related to data inaccuracies, delays, omissions, misclassifications alert delivery failures, or service interruptions

To the extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of:

  • $100 USD
  • The total amount paid by you for the Service in the twelve (12) months preceding the claim.

Nothing in this section limits liability where such limitation is prohibited by applicable law.

User responsibilities

Users agree to:

  • Use the Service lawfully
  • Not interfere with operation of the Service
  • Not attempt unauthorized access
  • Not abuse APIs or automated systems
  • Verify critical information through official sources

Intellectual property

The Service, including its design, software, and original content, is protected by applicable intellectual property laws. Government recall information remains subject to its respective source and applicable laws.

Termination

We may suspend or terminate access to the Service at any time and for any reason.

Changes to terms

We may modify these Terms of Service at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Governing law

These Terms shall be governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
